Within the first couple of days, a new law school student quickly realizes the truth of the adage: "General Rules Are Generally Inapplicable". This adage should be a warning for the use of the materials provided and text on this website. Under Florida law, the exemption of a homestead from seizure and sale for debts is a different thing from the exemption to the extent of $25,000 of a homestead from taxation, and a homestead as defined for tax purposes, is not necessarily a homestead that is non-devisable. The exemption of a homestead from forced sale and from having a judgment or execution being a lien thereon differs from homestead property tax exemption, as defined for ad valorem tax purposes. The fact that so many people are being misled about the titles “paralegal” and “legal assistant”, the Supreme Court of Florida passed a rule saying that it is not proper for a nonlawyer to use those titles if they are providing services directly to the public. Paralegals working in a law office often do have training and are often certified. They also have a code of ethics to follow and work under the lawyer’s supervision, not on their own. Nonlawyers who do not work for a lawyer may not have any training and should not be using the title paralegal. The only thing the nonlawyer can do legally for you is sell you a pre-printed form and type in the information that you provide to them. They cannot tell you what information you should put on the form or what type of form to use. Basically, the nonlawyer can act as a secretary or typist. This is the only service that we provide at Florida Homestead Services, LLC. A legal assistant or paralegal must act under the supervision of an attorney who is a member in good standing with the Florida Bar.  Even then, the allowable activities are limited. Electronic Signature Disclosure

Florida statutes (Chapter 668) permit the use of electronic signatures. This allows your typed name that is provided to be used on any application to any government agency or any agent as your legal signature. Even though your name is typed, it has the same legal force and effect as if it is a handwritten signature. An applicant giving false answers in any electronic application or document utilized by any government agency, is subject to the same penalties of perjury under the law as if you signed the application by hand.  

You must understand that you shall be required to furnish certain personal and confidential information to an agent and/or the local county Property Appraiser, and/or the Clerk of the Court, for the purpose of determining that you are a permanent resident as defined in s. 196.012(17) and entitled to any statutory exemption. Section 196.131 (2), Florida Statutes provides that any person who knowingly and willfully gives false information for the purpose of claiming homestead or any other statutory exemption is guilty of a misdemeanor of the first degree, punishable by a term of imprisonment not exceeding 1 year or a fine not exceeding $5,000 or both.

The Company services provided do not include domestic or foreign tax planning and or legal advice and Client acknowledges that he or she has been advised to consult with a tax professional or attorney concerning any tax or legal issues. This nonrefundable service retainer is earned when paid. No additional services, including legal services or legal representation shall be provided by any third party unless the same is negotiated and the terms thereof are set forth by separate agreement with the applicable party. I understand that reasonable consultations, by telephone, regarding the matters of the issues specified herein until such time as the documents are executed and finalized, shall be included in the Company services provided without any additional fee.  

Client understands that, in order for the Company to provide proper services to the Client, the Company must be in possession of all relevant information and facts concerning Client and Client's situation. Client represents and warrants that he/she shall be truthful with the Company and that he/she will disclose all information necessary for the Company to carry out the services requested on Client's behalf. The Company shall carefully maintain the Attorney-in-fact-Client privilege and will not disclose any information to third parties unless the Company in its discretion believes such disclosure is necessary to carry out the services set forth in this agreement on Client's behalf and is in the Client's best interests or that which is required by applicable law. Client understands that all company documents are copyright and protected under applicable law. Client further represents and warrants that Client is not engaging the Company’s services as an instrument of fraud, for any improper or illegal purpose or activity including but not limited to actual or attempts to evade, hinder, delay, defraud, or avoid attachment of Client's monies or property by known and/or existing or future creditors, is not engaged in fraud, fraudulent, egregious or reprehensible conduct, improper interference or transfer of community or marital property or illegal tax evasion or other said acts toward any entity or person. Client also understands and agrees that, in the event that Client has employed the Company services for any improper purpose in addition to those stated herein, that the Company will immediately withdraw from the services rendered of and to Client without refund of any portion of the fees paid to the Company by Client. Client agrees to indemnify and hold the Company harmless and to indemnify and to defend the Company against any and all loss, damages, costs, claims and expenses that may be incurred for any reason. Client represents that the Company is not liable and is held harmless for any and all local or county government office, agent or sub-contractor delay, loss, incompetence or mishandling. In no event shall Florida Homestead Services, LLC or its agents be liable for any incidental, special, indirect or consequential damages, whether resulting from the use, misuse, or inability to use the product or services provided or from any and all defects in the product or services. Client also understands that the process may take up to thirty days to be complete.

If this or any other agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and remain in effect.  

This agreement may not be modified by subsequent agreement of the parties but may be amended only by an instrument in writing signed by both of them or by an oral agreement to the extent the parties carry it out.  

The effective date of this agreement will be the date when, having been accessed by Client, it is received by the Client on Client's computer, from the Company and the Company receives the communication, request or and initial deposit required by this agreement.  

This agreement shall be construed under the laws of the State of Florida and any action brought to enforce or to interpret the terms of this agreement may be brought only in a court in Broward County, Florida. The parties hereto do hereby submit to the jurisdiction of the courts of the State of Florida.              

Client understands that this agreement and incorporated terms and conditions creates a lien against Client’s interest in property. Client is advised that Client has the right to seek review of this agreement by independent counsel of Client’s choice and Client acknowledges by verbal acceptance or request for documents or by signing this agreement that Client is aware of this right, has taken adequate time to obtain such review, if desired, and has either waived or exercised said right as of the date of signing this agreement. I have read the terms of this fee agreement and I understand, agree, and accept all of the terms.
