THIS WEBSITE IS AN ADVERTISEMENT OF SERVICES. NOTHING PROVIDED
HEREIN IS AN OFFICIAL DOCUMENT OF THE STATE OF FLORIDA.
The information contained in this
web site is educational and intended for informational purposes only.
It does not constitute legal advice, nor does it substitute for legal
advice. The opinions expressed in the web site are solely the opinions
of the company or its agents and are not intended as a legal treatise
or legal advice. The company,
its agents, nor the author may not be licensed nor otherwise authorized
to practice law in any state, nor do they hold himself or herself out
to the public as qualified to practice law in any state, nor do they
willfully pretend to be, or willfully take or use any name, title,
addition, or description implying that the company, its agents or the
author is or are qualified, or recognized by law as qualified to
practice law in any state if no such authority exists. No claims to
government works are claimed. Florida Homestead Services, LLC’s offers
strictly information services that are not considered as rendering
legal advice and any references thereto are hereby fully and
strenuously disclaimed. If you read or browse our web site, submit or correspond with a question or comment on such a topic, we will assume you are interested in soliciting and receiving or giving general factual and relevant information all available in the public domain free of charge by interested persons, for discussion and non-legal use rather than professional or legal advice and you hereby agree to all terms and conditions stated herein, including the understanding that we may not be lawyers. You should bear in mind that the applicability of such general or factual information might vary substantially in different states, counties or jurisdictions or times according to the individual factual circumstances surrounding a particular question, situation, experience or comment. Accordingly, if you desire or require professional advice, please consult a qualified provider who is licensed in your state or county. Again, we do not give legal advice whatsoever and all references to such advice is hereby disclaimed. We do not practice law. We provide, sometimes for a fee strictly for our time and efforts, specific services, referrals and specific information available in the public domain to anyone and/or any average person diligent enough to find it and spend the time doing their due diligence. You pay us only for our time. All data, statements and recommendations given by Florida Homestead Services, LLC or contained in this website or in any information herein are based on the best information available and are believed to be reliable, however no warranty, either express or implied is made concerning any application of our forms, statements, communications, or products since the customer's use of it cannot be controlled. While we
have included a great deal of case opinions, statutes, and other legal
materials, all available in the public domain, for you to read on our
website, it is impossible for us to comprehensively maintain a complete
database for each topical area of information displayed or
jurisdiction. To the contrary, we maintain this website only as an
information service and add to this website only as our time allows and
as new legal opinions permit. Thus, some materials herein may be out of
date, or have been superseded by other statues or court opinions, or be
totally worthless. Thus, this website should be viewed only as a
starting place for research on the issues discussed herein, and not as
the definitive final answer or legal advice of any type. No
professional would dare rely on these materials without substantial
further outside investigation for the most current information. Even
when we ourselves use this website as a resource, it is only a starting
place for information and we always do further and current research.
Certainly, nothing herein is, nor is even meant to be, any substitute
for the services, advice, or counsel of a licensed attorney practicing
in the relevant area of expertise in the relevant jurisdiction. Under Florida law, the exemption of a homestead from seizure and sale for debts is a different thing from the exemption to the extent of $25,000 of a homestead from taxation, and a homestead as defined for tax purposes, is not necessarily a homestead that is non-devisable. The exemption of a homestead from forced sale and from having a judgment or execution being a lien thereon differs from homestead property tax exemption, as defined for ad valorem tax purposes. We only provide factual information based on these court statements. We perform only a service based business under the strictest
standards as enumerated in Florida Bar v. Brumbaugh, 355 So.2d 1186,
1194 (Fla. 1978) (The sale of legal forms and their instructions
to the general public rather than to a specific individual for a
particular legal problem does not constitute the practice of law) Nothing in the information given herein on this website should imply that the members or agents of Florida Homestead Services, LLC are lawyers or admitted to practice law in the referenced state unless otherwise noted nor have any special professional expertise in the areas listed. Nothing herein or on this website should be construed as a solicitation by Florida Homestead Services, LLC or its members or agents to practice law in the referenced state. Persons desiring legal or estate planning should contact a licensed attorney or other appropriate planning professional in this state. Nothing herein is any substitute for the services, advice, or counsel of a properly licensed attorney in this state. We do not give legal advice and make decisions on behalf of another person that requires legal skill and a knowledge of the law greater than that possessed by the average citizen. We only provide facts and public information that is readily available on the internet. We do not give legal advice to another person concerning the application, preparation, advisability, or quality of any legal instrument or document or forms thereof in connection with any legal proceeding or procedure. We do not construe or interpret the legal effect of Florida or Federal laws and statutes for another person, as those laws relate to any legal matter including probate, dissolution of marriage and bankruptcy matters. We do not give advice and/or explain legal remedies and options to another person that affects their procedural and substantive legal rights, duties and privileges. We do not have direct contact with another person in the nature of consultation, explanation, recommendation, advice and assistance in the provision, selection and completion of preprinted legal forms. We do not advertise in any fashion that may lead a reasonable lay person to believe that the company offers to the public legal services, legal advice, or personal legal assistance. We do not engage in personal legal assistance in conjunction with our business activities, including the correction of errors and omissions. We do not engage in any personal legal assistance in the preparation of legal forms including correcting customer's errors or omissions or providing customers with any assistance in preparing the forms other than mere typing, filing or notarization services. The information given on these pages are for educational and informational purposes only, and shall not constitute any legal or tax advice or opinion. Again, the information contained on this website has been prepared by Florida Homestead Services, LLC for informational purposes only and not intended as legal advice to any person or entity. These pages are meant to merely give a synopsis of the available exemptions and facts associated with such exemptions to use for further research by other persons or professionals, but it should absolutely not be relied upon for any legal purposes whatsoever. Additionally, and as previously stated, these pages are kept current only as our time allows, and the information given here may not be fully and completely current. Professionals who utilize information provided herein must necessarily verify that it is correct and current. The text herein on this website or in our book is provided only for strict purposes of information and verbal discussion. The company, copyright holder, author and publisher have not followed up on, nor Shepardized™ any court cases or opinions cited or discussed therein. The company,
copyright holder, author and publisher are unknowledgeable regarding
the subsequent dispositions of any court cases or the effects of any
court opinions, current or subsequent, or if they have been
subsequently overruled or superseded by other court cases or by law or
statute. Legal opinions are afforded only to a select few in today’s
society, and are as such, a matter of public record therefore
defamation or plagiarism cannot be obtained for republishing them.
Occasionally legal opinions are reversed, vacated, or modified. The
company, copyright holder, author and publisher do not desire to publish inaccurate or outdated
information. If a legal opinion re-printed herein has been reversed,
vacated, or significantly modified, please advise the webmaster or the
author. The fact
that so many people are being misled about the titles “paralegal” and
“legal assistant”, the Supreme Court of Florida passed a rule saying
that it is not proper for a nonlawyer to use those titles if they are
providing services directly to the public. Paralegals working in a law
office often do have training and are often certified. They also have a
code of ethics to follow and work under the lawyer’s supervision, not
on their own. Nonlawyers who do not work for a lawyer may not have any
training and should not be using the title paralegal. The only thing
the nonlawyer can do legally for you is sell you a pre-printed form and
type in the information that you provide to them. They cannot tell you
what information you should put on the form or what type of form to
use. Basically, the nonlawyer can act as a secretary or typist. This is
the only service that we provide at Florida Homestead Services, LLC. A legal assistant or paralegal must act under
the supervision of an attorney who is a member in good standing with
the Florida Bar. Even then, the allowable
activities are limited. The preparation of legal
documents by a non-lawyer for another person to a greater extent than
typing or writing information provided by the customer on a form,
constitutes the Unlicensed Practice of Law in Florida. We do not
practice law! The legal court opinions herein or published on these web sites or in our book or other publications or correspondence from us are a matter of public record, and as such there can be no defamation for republishing them. Sometimes, however, legal court opinions are reversed, vacated, or significantly modified, etc., and we do not discover this fact until someone points it out to us. As we do not desire to publish inaccurate or outdated information, if a legal opinion has been reversed, vacated, or significantly modified, please advise us of this fact immediately, or you may also send regular correspondence to us via e-mail. The information herein, on our web site(s) or in our book shall not constitute legal advice or legal opinion, and may not be relied upon for any legal purpose or strategy. It is provided solely and exclusively for general, non-specific educational purposes only to the general public. The information given herein, in our forms or in our book is not meant to be a substitute for adequate and competent legal counsel and representation. The text herein or in our book is distributed with the understanding that neither the company, publisher nor the author is offering legal or other professional advice. Any actions with regard to the information contained therein should be undertaken only with the advice and counsel of a trained legal professional fully knowledgeable in the required areas of legal jurisprudence and specializing in asset protection. The company, copyright holder, author and publisher do not provide any asset protection related services, nor do they provide any counseling, advice, opinions, strategies, effects, ideas, products, shelters, or anything else of a related nature on such matters. Any mention by the company, copyright holder, author or publisher of the possible effects or consequences of any court cases, strategies or opinions herein, or any asset protection techniques or strategies whatsoever, are not intended to induce the reader to utilize such techniques or strategies due to any real or perceived advantages without the proper assistance of very highly qualified legal counsel specializing in the required areas of law, and certified by the state bar as qualified. If you desire such asset protection planning or strategy opinions you should contact a certified bar member lawyer within your proper legal jurisdiction. The company, copyright holder, author and publisher do not make any guarantees or assurances in connection with any text, product, transaction or strategy discussed herein or provided by the company, copyright holder, author or publisher. All readers are strenuously urged to consult the current laws and statutes within their proper legal jurisdiction before the application of any legal process, strategy or technique. We do not engage in the unlicensed practice of law nor do we provide legal services or advice by providing customers with legal assistance in the selection, preparation, and completion of legal forms; correcting customers' errors or omissions; preparing or assisting in the preparation of pleadings and other legal documents for their customers; correspond with opposing parties or the attorneys of opposing parties as the representative of a customer in a legal matter; hire an attorney to provide legal advice to customers; hold an attorney out to customers as a supervising attorney; and advertise services in such a way that leads the public to believe that we are capable of providing legal services. We do not engage in direct contact with individuals in the nature of consultation, explanation, recommendations, advice, and assistance in the provision, selection, and completion of legal forms. The transmission, and/or your receipt of information or correspondence and forms from the company or this website creates a relationship between you and Florida Homestead Services, LLC. All terms and conditions herein are fully enforced. Internet subscribers and online readers should not act upon information contained in this website without seeking the advice of an attorney exclusively and highly trained in homestead and property asset protection law. Homeowners who are in financial trouble or those who expect that they may encounter financial trouble should consult a qualified attorney for legal advice on how to protect their home, as agents of Florida Homestead Services cannot and shall not render any legal advice or engage in the practice of law whatsoever. The policy of FHS continues to be one of supporting the courts and the bar association in their protection of the public, and strenuously encouraging persons who are unsure of their legal rights and remedies to seek qualified legal assistance from persons who are members of the bar granted the privilege to practice law in this state. For more information, see our web page on unlicensed practice of law. DISCLAIMER, WARNING AND NOTICE Florida Homestead Services, LLC is not associated with any government agency. review all policies required
by law to be posted on this site. These policies
govern your visit and business dealings with and to Florida Homestead
Services, LLC and floridahomesteadservices.com. We reserve the right to
make changes to our site, book, policies, procedures, prices,
advertisements, links, etc., and these "Conditions of Use" at any time
without prior notice. If any of these conditions shall be deemed
invalid, void, or for any reason unenforceable, that condition shall be
deemed severable and shall not affect the validity and enforceability
of any remaining condition. This regulation and our policies
control those who provide services and
accomplishes several things. It (a) requires certain disclosures, (b)
prohibits certain misstatements, (c) defines the minimum kinds of
services that must be provided by one who
provides services through Florida Homestead Services, LLC, (d)
rigorously limits the statutory fees that can be charged, and (e)
requires agents to act in the best interests of the client, to be
truthful and factual, and to act at all times beyond reproach in all
communications and matters regarding clients, potential clients,
licensees or agents. Failure to act in the highest ethical manner will
result in the termination of an agent and subsequent causes of legal
action against the agent. The regulation limits the statutory and other
fees that can be charged in addition to the services rendered. To help
assure that customers are not mislead about the need for our services
or the enormous protections that it provides, a service agent must
include a prescribed disclosure in every advertisement, promotional
material and other offer made before the time when the client is
obligated to pay for the service. In the case of an oral solicitation
or broadcast advertisement, the disclosure should be recited at the
beginning of the presentation. In the case of a printed ad or other
promotional material, the required disclosure must be printed. This regulation also controls
agents who provide services and makes it unacceptable for the service
provider to make certain statements about the law
or the particular
service that the agent provider is
offering: First, all statements that are false
or misleading
are prohibited. Second, certain
kinds of representations are altogether prohibited.
